GOVERNOR VETOES AB 1220

The Governor decided to veto AB 1220 on Sunday – the last day he was able to take action on a bill. This bill was modeled after AB 602 from last year, which was also vetoed by then Governor Arnold Schwarzenegger. While it was vetoed last year, the exact same language returned this year. AB 1220 would originally have expanded from one year to five years the statute of limitations to sue a city or county, challenging the adoption of a housing element or a number of related ordinances – substantially longer than the 90-days to challenge the entire General Plan or 30 days to challenge a CEQA document. It would have encouraged a broad array of expensive lawsuits leaving local agencies, businesses, and developers unfairly open to uncertainty long after decisions have been made.

This bill was a top priority for APA as well as the League and CSAC. To stop this bill there were numerous meetings with members and staff as well as testimony and letters sent to both houses in every committee it went to. While the bill made it to the Governor, it did not do so without a fight. Because of strong opposition from APA, the League, CSAC and others, at the end of session, the housing advocates amended the bill to allow a three-year statute of limitations. However, the process in the bill would actually have allowed four years to sue. In meeting with the Governor’s office, we argued that three years was simply too long, eliminating the certainty that the housing statute was designed to provide. Clearly, the Governor agreed.

Thank you to all APA members who sent letters to the Governor asking for the veto. The Governor's veto message is below. The message is short, but to the point – and in agreement with APA's core reasons for opposing this bill.

I am returning Assembly Bill 1220 without my signature. This bill increases the statute of limitations from 90 days to 3 years for a citizen to file a Notice of Deficiency in a locally adopted housing element. While I understand the value of using the courts to compel compliance with state housing goals, there should be a balance between a local government's planning authority and citizen oversight. This bill tilts that balance and creates too much uncertainty. Sincerely, Edmund G. Brown Jr.

AB 1220 passed the last week of session and is on the Governor's desk. The bill would expand from over one year to three years the statute of limitations to sue a city or county, challenging the adoption of a housing element or a number of related ordinances. While AB 1220 was introduced with a five year SOL, during the last week of session the bill was amended to three years. The bill is still too long and we have requested a veto from the Governor.

The Strategic Growth Council launches its Funding Wizard

On June 29, 2011, the Governor signed AB X1 26 and AB X1 27. The bills took effect immediately upon the Governor’s signature.

AB X1 26 legislates that redevelopment agencies are now prohibited from taking a number of actions, including incurring indebtedness, making loans, entering into or modifying contracts, and adopting or amending redevelopment plans. Redevelopment agencies are now also subject to a number of responsibilities, including preserving all assets, minimizing all liabilities, and preserving all records.

Redevelopment agencies that do not comply with the provisions of AB X1 27 will be dissolved as of October 1, 2011. Except for those provisions of the Redevelopment Law that are repealed, restricted, or revised by AB X1 26, all authority, power, and obligations previously vested with agencies pursuant to the Redevelopment Law will vest in successor agencies upon such dissolution.

Under AB X1 27, a redevelopment agency may resume its activities (i.e., be exempted from the provisions of AB X1 26 and thus continue to exist) upon the city’s adoption of an ordinance stating its participation in the Alternative Voluntary Redevelopment Program, which requires the city to make certain specified annual payments to the county auditor for distribution to schools, fire protection agencies, and transit agencies beginning in fiscal year 2011-2012. The city must adopt this ordinance on or before November 1, 2011.

It is expected that the League of California Cities and the California Redevelopment Association will file legal challenges to the bill in the near future, asserting, among other things, that the bills are unconstitutional and in conflict with Proposition 22. Proposition 22 is the 2010 ballot measure, passed with the support of 61% of the voters, that intended to prohibit the State from “seizing, diverting, shifting, borrowing, transferring, suspending, or otherwise taking or interfering with revenues dedicated to funding services provided by local government or funds dedicated to transportation improvement projects and services.” (Prop. 22, Sec. 2.5)

Stay tuned, as there is likely to be more twists and turns before this saga is over.

LEGISLATURE PASSES REDEVELOPMENT ELIMINATION MEASURES – FATE UNCERTAIN AS GOVERNOR REVIEWS BUDGET PACKAGE ON HIS DESK

LEGISLATURE PASSES REDEVELOPMENT ELIMINATION MEASURES – FATE UNCERTAIN AS GOVERNOR REVIEWS BUDGET PACKAGE ON HIS DESK

Yesterday, the Senate and Assembly passed a budget package by majority vote. Today, the Governor vetoed two of the largest budget measures.

However, two key redevelopment bills that also passed yesterday with the budget package remain on the Governor’s desk in limbo. Those two bills would effectively eliminate existing redevelopment agencies. The Governor has not yet indicated what he plans to do with those two bills although in the past he has said he wants redevelopment to be eliminated, not reformed.

The first bill, AB 26X, would abolish redevelopment agencies and provide for them to be phased out over time. The second bill, AB 27X, would create “an alternative voluntary redevelopment program”. When a community elects to participate in this new alternative program, it would be exempt from elimination. However, that exemption comes with hefty price tags: those that participate would have to agree to pay their share of $1.7 billion to schools in 2011-12, and thereafter shift their proportional share of $400 million to school, fire districts, and transit districts. Those payments could be reduced if agencies agree to projects and programs that meet state goals. For new debt or new project areas, communities would have to shift 80% of the school shares minus pass-throughs to schools. The housing set-aside would be fully funded beginning in 2012-13 and thereafter. These financial concessions might make it infeasible or impractical for some agencies to go this route.

APA took a position early in the year to support reforming redevelopment law and oppose across-the board elimination. Redevelopment agencies perform important planning and economic development functions and should remain an important tool for local governments to use.

Brown today said he has not yet taken action on several trailer bills in the budget package, and indicated he wouldn’t veto them all. He also did not specify which bills he would sign.

He has 12 days to make a decision about the redevelopment measures. We will keep you posted.

Orange County APA Chapter Hosts Annual APA Conference

GARDEN GROVE, CA: The Orange County Chapter of the California Chapter of the American Planning Association will host the annual Conference at the Hyatt Regency Orange County on October 22 – 25th.

Each year the California Chapter provides a Statewide Conference to provide networking and educational opportunities for its members. These popular conferences attract planning professionals from all over California, the United States and the world. Conferences typically include an opening reception in a special venue, keynote speakers, concurrent tracks of programs and seminars including practical "nuts and bolts" sessions, mobile workshops to local planning related venues, the CCAPA Awards Dinner, and the California Planning Foundation Auction to fund scholarships for planning students.

APA California Chapter remains among the leaders of the 47 chapters nationwidebecause you take the time to select qualified candidates for statewide office. As in past years, the Nominating Committee has done an excellent job of selecting candidates for this election. Using selection criteria that include experience and qualifications; geographic, ethnic, and gender diversity; and a balance of interests between the public, private, academic, and lay communities, the Nominating Committee, with approval from the APA California Chapter Board of Directors, has selected highly qualified candidates for your consideration.

Your participation in the election process keeps APA California strong.

Both CalPlanner and the Chapter website carry announcements throughout the year encouraging potential candidates to run.

However the printing and mailing processes are more time and resource (paper, postage, energy, etc.) intensive than communicating digitally. To help reduce our consumption footprint and provide more information via images, video, sound, links and Web databases, we are migrating to an e-mailed digital Cal Planner that would be more integrated to the APA California Web site. For members who do not have e-mail or Web access, an alternative method of Cal Planner delivery will be created. The following questionnaire will help us transition to a digital Cal Planner with desired features and functions.
