Cities throughout the world are implementing Bus Rapid Transit (BRT) projects — a less costly form of transit service that can mimic the benefits of light rail. San Francisco has finished the planning for Van Ness BRT and continues planning for Geary BRT, while Santa Clara County will begin construction on Santa Clara-Alum Rock, El Camino and Stevens Creek BRT. Join us for a review of these major transit investments and the challenges these projects face. Revised Infill Streamlining Guidelines (SB 226)

The Governor’s Office of Planning and Research (OPR) is pleased to announce that it has released a revised draft of updates to the CEQA Guidelines addressing streamlining for infill development pursuant to SB 226 (Simitian, 2011). Many stakeholders provided helpful feedback and suggestions for improvement to the preliminary discussion draft released in late January. The revised proposal reflects many of those comments as well as OPR’s continued research on issues raised during this update process. Revisions to Proposed Section 15183.3 and Proposed Appendices M and N, along with a summary and responses to comments, are available on OPR’s website: http://opr.ca.gov/s_sb226.php. Scoping Workshop Announcement

The Department of Conservation, Division of Land Resource Protection (DLRP), is hosting a scoping workshop to discuss the possible adoption of regulations needed to implement provisions of SB 618 – Wolk, Local government: Solar‐use easement.

Date/Time: Friday, May 18, 2012, 10:00 AM – 12:00 PM, Pacific Time Location: California Natural Resources Agency Auditorium, 1416 9th Street, Sacramento, CA

Purpose: The Department of Conservation is conducting this workshop to increase public participation and improve the quality of regulations, as is advised by California Government Code section 11346.45. The Department would like to hear questions and comments regarding:

• The necessity of regulations to implement SB 618. • Methods and information needed to make eligible land determinations for solar

easements. • Direction on the development, adequacy, and use of Soil Management Plans. • Any fees the Department may need to charge to cover the costs to carry out new

responsibilities assigned by the Act. • Any other issues on this topic that may be of interest to workshop participants.

Audience: This workshop should be of particular interest to County Planning Departments, solar PV industry members, investor and public utility representatives, local and state farm organizations; non‐profit organizations with an interest in agricultural land use and renewable energy development; state agencies and departments, and members of the Legislature and their staffs.

Draft California Climate Adaptation Policy Guide Feedback

The California Natural Resources Agency, California Emergency Management Agency and California Polytechnic State University - San Luis Obispo (Cal Poly) seek feedback on the newly released draft Adaptation Policy Guide (APG). The APG provides a method to aid local communities and regional entities in evaluating vulnerabilities and devising strategies to address climate change impacts. The APG is not intended to provide a prescriptive set of strategies. Instead, it will provide a framework to guide decision makers through the critical considerations necessary for adaptation policy development. The Draft APG was released to the public and the comment period began as part of the April 9^thImpacts and Local Adaptation Conference, organized by the Governor’s Office of Planning and Research.

Feedback is critical for refining the Adaptation Policy Guide to best serve local and regional users. The draft APG can be accessed, and comments sent, through the Climate Adaptation Portal.

Comments will be received through Monday, May 18^th, 2012.

GOVERNOR VETOES AB 1220

The Governor decided to veto AB 1220 on Sunday – the last day he was able to take action on a bill. This bill was modeled after AB 602 from last year, which was also vetoed by then Governor Arnold Schwarzenegger. While it was vetoed last year, the exact same language returned this year. AB 1220 would originally have expanded from one year to five years the statute of limitations to sue a city or county, challenging the adoption of a housing element or a number of related ordinances – substantially longer than the 90-days to challenge the entire General Plan or 30 days to challenge a CEQA document. It would have encouraged a broad array of expensive lawsuits leaving local agencies, businesses, and developers unfairly open to uncertainty long after decisions have been made.

This bill was a top priority for APA as well as the League and CSAC. To stop this bill there were numerous meetings with members and staff as well as testimony and letters sent to both houses in every committee it went to. While the bill made it to the Governor, it did not do so without a fight. Because of strong opposition from APA, the League, CSAC and others, at the end of session, the housing advocates amended the bill to allow a three-year statute of limitations. However, the process in the bill would actually have allowed four years to sue. In meeting with the Governor’s office, we argued that three years was simply too long, eliminating the certainty that the housing statute was designed to provide. Clearly, the Governor agreed.

Thank you to all APA members who sent letters to the Governor asking for the veto. The Governor's veto message is below. The message is short, but to the point – and in agreement with APA's core reasons for opposing this bill.

I am returning Assembly Bill 1220 without my signature. This bill increases the statute of limitations from 90 days to 3 years for a citizen to file a Notice of Deficiency in a locally adopted housing element. While I understand the value of using the courts to compel compliance with state housing goals, there should be a balance between a local government's planning authority and citizen oversight. This bill tilts that balance and creates too much uncertainty. Sincerely, Edmund G. Brown Jr.

Veto Request for AB 1220: Statute of Limitations on Housing Elements

AB 1220 passed the last week of session and is on the Governor's desk. The bill would expand from over one year to three years the statute of limitations to sue a city or county, challenging the adoption of a housing element or a number of related ordinances. While AB 1220 was introduced with a five year SOL, during the last week of session the bill was amended to three years. The bill is still too long and we have requested a veto from the Governor.

The Strategic Growth Council launches its Funding Wizard

The Strategic Growth Council recently launched its Funding Wizard. This tool will provide a public clearinghouse to identify all financial incentives available in California. It will assist cities and counties with identifying grants, loans, tax incentives, technical assistance, and other opportunities to finance energy efficiency, green transportation, renewable energy, water efficiency, waste reduction, green building, and other sustainability projects that can contribute to reducing greenhouse gas emissions.

Orange County APA Chapter Hosts Annual APA Conference

GARDEN GROVE, CA: The Orange County Chapter of the California Chapter of the American Planning Association will host the annual Conference at the Hyatt Regency Orange County on October 22 – 25th.

Each year the California Chapter provides a Statewide Conference to provide networking and educational opportunities for its members. These popular conferences attract planning professionals from all over California, the United States and the world. Conferences typically include an opening reception in a special venue, keynote speakers, concurrent tracks of programs and seminars including practical "nuts and bolts" sessions, mobile workshops to local planning related venues, the CCAPA Awards Dinner, and the California Planning Foundation Auction to fund scholarships for planning students.
